The Project "Road to The Hague" (belaruswomen.org), launched by the Belarus Women’s Foundation in 2020, is entering a new phase.
The International Criminal Court has concluded its preliminary examination of the situation concerning crimes committed by the Lukashenka regime against Belarusians. The Court confirmed that it may exercise jurisdiction over potential crimes against humanity, including persecution and the forced displacement of Belarusians into Lithuania. This opens the door to a possible international criminal investigation and the potential prosecution of representatives of the regime.
Meaning and significance of the ICC decision:
The Prosecutor of the International Criminal Court has concluded the preliminary examination of the “Lithuania / Belarus” situation.
The Court determined that it has jurisdiction to consider alleged crimes related to the actions of the Belarusian authorities, particularly the persecution and forced displacement of Belarusians, part of which occurred on the territory of Lithuania.
This is significant because Belarus is not a member of the ICC. However, the Court may exercise jurisdiction if part of the alleged crimes occurred on the territory of a state party to the Rome Statute — in this case, Lithuania.
Why this matters
- it opens the possibility of an international criminal investigation into representatives of the Lukashenka regime;
- it could potentially lead to the issuance of arrest warrants;
- it represents the first real legal pathway toward accountability for crimes against humanity committed after the 2020 repression in Belarus.

Международный уголовный суд завершил предварительное изучение дела о преступлениях режима Лукашенко против беларусов. Суд признал, что может рассматривать возможные преступления против человечности, включая преследование и принудительное изгнание людей в Литву. Это открывает путь к международному расследованию и возможной уголовной ответственности представителей режима.
Смысл и значение решения МУС (ICC):
Прокурор Международного уголовного суда завершил предварительное изучение дела “Литва/Беларусь”.
Суд признал, что есть юрисдикция рассматривать возможные преступления, связанные с действиями беларуских властей, в частности принудительное изгнание и преследование беларусов, часть которых происходила на территории Литвы.
Это важно, потому что Беларусь не является членом МУС, но суд может рассматривать дело, если часть преступлений произошла на территории страны-участницы (Литвы).
Почему это важно:
- открывается возможность международного уголовного расследования против представителей режима;
- потенциально может привести к выдаче ордеров на арест;
- это первый реальный юридический путь привлечения беларуских властей к ответственности за преступления против человечности после репрессий 2020 года.
